Failure To Call A Lawyer

10.  Failure To Call A Lawyer:  From the moment that an accident is reported to an insurance company, they are working to minimize their exposure to you.  They are out there protecting themselves from your claim.  That is why their investigators are taking pictures, interviewing witnesses, asking you to sign medical records authorizations, and asking you to provide them with a recorded statement.  Who is doing this for you?  NO ONE!  Not even your insurance company.  They do not care about your injuries and pain and suffering as a lot of the time this will not be a claim that you are making on your own policy.  They are not protecting you.  They don't need to and won't when the accident is not your fault.  At BISSELL LAW CORPORATION we will help protect your rights and document your case properly so that evidence is not lost, and the value that you deserve for your case is not diminished.  Call Attorney Todd Bissell today 916 458-4244.

Wrong-way car on 99

 By Kevin Valine
The Modesto Bee

Monday, Jun. 28, 2010

A wrong-way driver caused a six-vehicle smashup on Highway 99 on Saturday night that sent seven people to the hospital and closed the northbound lanes for about two hours.

The California Highway Patrol said the driver was under the influence of alcohol as he drove south in the northbound lanes. His 2001 Chevrolet Silverado hit an oncoming 2003 Lexus and rolled multiple times, striking several vehicles. Read More

Mistake #1. FAIL TO CALL THE POLICE

You should call the police every time that you are in a car accident and request that they come to the accident scene and make a report.  They may tell you that they will not come unless you need a tow truck or have an injury.  Therefore, if you hare having any symptoms at the scene, report those when calling the police, and they should send out an officer to take a report.  Do not assume that the person who just admitted causing the accident will maintain that responsibility.  Often their story will change if no one is there to put the blame on them.

What Should I Do?

I Have Been In An Accident, Now What Should I Do? Your location. Time of the accident. Parties involved. These are the only facts you can safely state to any insurance company, even your own, if you are involved in a car accident. Other statements you make can and will be used against you in the future. The 10 Biggest Mistakes You Can Make:

4. TELL THE OTHER DRIVER THAT YOU ARE "OKAY." Even if the other driver is very nice, and apologetic, do not tell him or her that you are Okay. Tell them of any complaints that you have no matter how small, or don't talk to them at all if you can get their contact information from the police or otherwise. Tell them if you are "shaken up" or have a headache or feel stiff. Any of those is better than telling them that you are fine when you are not. Anything you say is admissible against you. If you report that you are "Ok" or "not hurt" that is the first thing that the other driver will report to his/her insurance company, and that is a statement that you will hear them testify at trial that you said. Many soft-tissues swell over night after an accident, and you may feel awful the next morning after an accident that you thought did not injure you. 10 Biggest Mistakes

Big Rig Driver Fell Asleep = $1.6 Million

"The big rig driver admitted at the accident scene that he fell asleep when he crossed into my lane and nearly killed me. Later, he told his insurance company that he blacked out from some unknown medical condition. They refused to pay for my 5 surgeries. Todd personally conducted a complete investigation and located witnesses and evidence to prove the truth. Todd won my case for me which settled before trial for a value of $1.6 million."

My Insurance Company Would Not Pay

"I was rear-ended, and the insurance company for the man who hit me said that my car was not damaged enough to cause the injuries that I had. I needed two surgeries, and the man's insurance company said that these injuries were not caused by the car accident despite that my doctors said that they were. My first attorney was not able to get the insurance company to offer me anything! I transferred the case to Todd at the recommendation of a friend. At one point, they offered me $250,000. Todd suggested that I reject that. When I did, the insurance company got nasty and reduced their offer to only $50,000, and never offered more. Two settlement judges suggested that I take this smaller amount. Todd told me not to and to keep fighting. We took the case to a jury trial and Todd recovered for me a verdict of almost $600,000! Todd also forced the insurance company to pay for my legal costs, the expert fees of my doctors who had to testify, and interest on the money that the insurance company refused to pay me. Todd kept fighting for me and never gave up. Thank you, Todd."

One of the Most Dangerous Roads in the Country

Article provided by Christiansen Law Offices

Interstate 15 (or I-15) has long been considered one of the most dangerous roads in the US. In a 2005 MSNBC Dateline report, 1-15 was listed as the most dangerous high-speed road while a recent MSN list dubbed the infamous roadway as one of the "Highways to Hell." Over a five year period, 173 people died while traveling on Highway 15.

What makes the 125-mile stretch of highway between Las Vegas and Southern California so dangerous? It certainly is not the terrain - the land is flat and relatively risk free. Most reports point to driver behavior, including speeding, falling asleep at the wheel and driving under the influence of alcohol or drugs, as the main causes for the high number of deaths on I-15. For some time, it was rumored that the road was not patrolled regularly by the police, encouraging more bad behavior by drivers in a hurry to get to the Strip for a weekend getaway or in a rush to return home.
